At Jordyn’s Splash Academy, the safety and well-being of our swimmers is our top priority. This waiver outlines important information regarding participation in swim lessons, including acknowledgment of risks, emergency medical consent, liability release, and policies related to supervision, communicable diseases, media use, and more.

By signing this waiver, parents and guardians agree to the terms and conditions that help ensure a safe and supportive environment for all students. It also provides authorization for emergency medical care and clarifies expectations for behavior, attendance, and communication.

Informed Consent, Assumption of Risk & Release of Liability

Acknowledgment of Risk & General Release of Liability BY SIGNING BELOW, I ACKNOWLEDGE AND FULLY ASSUME ALL RISKS ASSOCIATED WITH PARTICIPATION IN ALL ACTIVITIES PROVIDED BY JORDYN’S SPLASH ACADEMY, LLC (HEREAFTER, ‘THE SCHOOL’) (E.G., SWIMMING LESSONS, AQUATIC FITNESS CLASSES, SAFETY WORKSHOPS, ETC.), WHETHER CONDUCTED ON-SITE, OFF-SITE, OR VIRTUALLY, INCLUDING THE RISK OF INJURY, ILLNESS, OR DEATH, WHETHER ARISING FROM KNOWN OR UNKNOWN RISKS. I HEREBY RELEASE, WAIVE, AND FOREVER DISCHARGE JORDYN’S SPLASH ACADEMY, LLC, ITS OWNERS, DIRECTORS, EMPLOYEES, CONTRACTORS, VOLUNTEERS, AGENTS, LEGAL REPRESENTATIVES, SUCCESSORS, ASSIGNS, AND ANY PROPERTY OWNERS OR FACILITY PROVIDERS USED BY THE SCHOOL (COLLECTIVELY, “RELEASED PARTIES”) FROM ANY AND ALL LIABILITY. THIS RELEASE INCLUDES, BUT IS NOT LIMITED TO, ANY AND ALL LIABILITY, CLAIMS, DEMANDS, OR CAUSES OF ACTION, KNOWN OR UNKNOWN, TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW. THIS WAIVER DOES NOT RELEASE CLAIMS RESULTING FROM GROSS NEGLIGENCE, RECKLESS CONDUCT, OR INTENTIONAL MISCONDUCT. Indemnification I agree to defend, indemnify, and hold harmless the Released Parties from and against any loss, liability, damage, or expense (including reasonable attorney’s fees) that they may incur due to any claim arising from my or my child(ren)’s participation in the Programs, to the fullest extent permitted by Texas law. Medical Information Disclosure I have disclosed all relevant medical conditions or concerns in the designated Medical Information section of the registration form, and understand it is my responsibility to update the School promptly if any such conditions change. I acknowledge that failure to disclose or update such information may increase risk, and the School is not liable for any consequences resulting from such omissions. Emergency Medical Authorization If I am unavailable and cannot be reached in a timely manner, I authorize the School or its representatives to secure medical treatment for myself or my child(ren), including but not limited to: emergency medical care, x-rays or imaging, surgical procedures, hospitalization, and treatment by licensed physicians, dentists, or emergency personnel. I understand that this authorization is granted in advance to ensure timely medical treatment and that reasonable efforts will be made to contact me or my designated emergency contact prior to treatment, unless delay would increase the risk. I further agree that I am financially responsible for any such care provided. Communicable Diseases (including COVID-19) Acknowledgment & Release I acknowledge the contagious nature of COVID-19 and other viruses or bacteria, and I voluntarily assume the risk that my child(ren) and I may be exposed while participating in the Programs. I accept full responsibility for all such risks and hereby release and hold harmless the School and all affiliated persons and entities from any claims or liabilities arising out of such exposure, even if caused by ordinary negligence. This release includes, but is not limited to, claims related to COVID-19 or other communicable diseases that may occur before, during, or after participation in the Programs. Agreement to Policies I agree that my family and I will comply with all School policies as communicated in writing by the School from time to time, including but not limited to health and safety procedures, behavioral guidelines, and facility rules, as amended from time to time. The most recently published version of such policies shall apply. Supervision Agreement I understand that for the safety of my child(ren), the School recommends that parents or guardians remain present during aquatic activities. I agree to supervise my child(ren) per School policy and acknowledge that failure to do so may increase risk and may result in removal from the program. Authority to Sign I certify that: • I am the legal parent or guardian of the child(ren) named above and have legal authority to enroll them in swim lessons or aquatic activities and execute this agreement on their behalf, OR • I have written authorization from the legal parent or guardian to enroll the child(ren) named above in swim lessons and execute this agreement on their behalf (a copy of such authorization must be provided upon request). I further certify that I have read and understand this Waiver and agree to its terms. Texas Law & Severability This agreement shall be governed by and construed in accordance with the laws of the State of Texas. If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect. Conspicuousness Acknowledgment

Client Agreement & Policies

Lesson Flexibility:

If you can’t make your scheduled lesson due to illness, injury, or another unforeseen event, you have the following options:

Gift your lesson to a friend, sibling, or neighbor (recipient must be a registered swimmer with Jordyn’s Splash Academy).

Contact support@jsaswim.com for unique circumstances.

Please note:

Lessons must be booked at least 48 hours in advance.

No refunds or account credits will be given for missed lessons.

Failure to reschedule or cancel a lesson 24 hours in advance will result in forfeiting the class credit and no refund will be issued.

Regular attendance is key to helping your swimmer make steady progress. Please do your best to attend each scheduled lesson!

Scheduled Lesson Time and Teacher:

Your lesson time is reserved specifically for you.

If you arrive late, your lesson will still end at the originally scheduled time.

Time before and after your lesson is reserved for other swimmers.

Inclement Weather and Lesson Attendance:

Lessons will only be canceled for:

• Consistent winds above 30 mph • Pool or equipment-related malfunction • Staff availability issue • Heavy rain Lightning or hail at our location

Jordyn’s Splash Academy will reschedule lessons that are canceled due to weather.

Cancellations and reschedules are initiated by Jordyn’s Splash Academy; do not assume a lesson is canceled.

A maximum of three (3) reschedule options will be provided. Please make every effort to attend one of the available options.

Single Swim Lesson Policy:

Single lessons must be rescheduled 48 hours in advance.

Failure to reschedule or cancel a lesson 24 hours in advance will result in forfeiting the class credit and no refund will be issued.

If the class is canceled up to 24 hours before the scheduled time, clients are eligible to reschedule the lesson.

Requests for refunds for single lessons must be made in writing (email to support@jsaswim.com), no more than 15 days after the scheduled class date.

Membership Enrollment Policy:

Memberships-

At registration, the first month’s tuition is billed immediately.

Tuition is billed on the same day each month until canceled

30-Day Cancellation Policy

Cancellation requests must be made in writing (email to support@jsaswim.com) at least 30 days before the start of the first lesson of your package.

If your request meets these criteria, you’ll receive a refund for your lesson package minus a 10% fee (covers merchant and processing costs).

Requests outside these parameters will not be approved.

30-Day Transfer Request Policy:

Transfer requests for Memberships and Prepaid Packages are subject to class availability and client waitlists.

All transfer requests must be made in writing (email to support@jsaswim.com)

If more than one reschedule is requested, or customer support is required to rebook, a $25 administrative fee applies.

Account credits (if issued) are valid for one calendar year. Unused credits are non-refundable.

Clients are not refunded or compensated for lost classes due to rescheduling (e.g., moving to a day that falls on a holiday).

All reschedules are subject to available and existing time slots.

Merchandise Return and Refund Policy:

Merchandise that is unworn, unused, unopened, and not tampered with can be returned within 30 days of purchase, minus a 25% restocking fee.

Returns are not permitted after 30 days or if merchandise cannot be restocked and sold as new.

Holidays:

Jordyn’s Splash Academy is closed on the following holidays: Easter, Independence Day, Thanksgiving, Christmas, and New Year. Some holidays extend for more than one day; see the schedule on our website for details.

If your session includes one or more of these holidays, the missed lesson will be credited to your account and may be used to schedule a makeup lesson at no additional cost.

Tuition, Fees & Payment Policy

Payment Authorization and Warranties I represent and warrant that if I am purchasing something or paying for a service from this facility or from other merchants through this facility that (i) any credit card information I supply is true and complete, (ii) charges incurred by me will be honored by my credit card company, and (iii) I will pay the charges incurred by me at the posted prices, including any applicable taxes, fees, and penalties. By providing your credit card information and accepting this agreement, you authorize Jordyn’s Splash Academy, LLC to charge your card for all recurring and one-time payments associated with your account, including tuition, registration fees, and any additional charges incurred. You agree to receive all notices and disclosures electronically. You further acknowledge that electronic signatures and acceptances are legally binding and equivalent to handwritten signatures, pursuant to the Texas Uniform Electronic Transactions Act (UETA) and the federal ESIGN Act. A 30-day written notice is required to terminate billing. You are responsible for payment whether or not your student attends classes until you notify this facility in writing to drop your student from class(es). All payment disputes must be submitted in writing to support@jsaswim.com within 15 days of the charge date. Disputes submitted outside this timeframe will not be considered. Disputed charges may be subject to additional fees, collection costs, and/or termination of services. Membership Payment & Enrollment Policy • Upon registration for the current month tuition is due immediately. • All tuition payments are non-refundable. Refunds, if issued, will be in the form of a credit to your Jordyn’s Splash Academy account. • Payments must be made by credit card. Checks, cash, and ACH payments are not accepted. • Non-payment of tuition will result in suspension of services after a 72-hour grace period for active lessons. If payment is not received by the 7th day after the due date, a notification of delinquency will be sent to the email address on file. Accounts remaining unpaid after 30 days will be referred to a collection agency, with applicable fees added to the outstanding balance. • If your payment method becomes invalid or is declined, you authorize Jordyn’s Splash Academy, LLC to request updated payment information and to continue to attempt to process payment. • Chargebacks and payment disputes will be reviewed upon written notification. Disputes must be submitted within 15 days of the charge date. Accounts subject to chargebacks may incur additional fees and result in the termination of services 30-Day Cancellation Policy • Memberships: To cancel a membership, submit a written request to support@jsaswim.com at least 30 days before the desired end date. Verbal requests will not be accepted. Tuition for the final month will be prorated based on the cancellation date using the proration formula above. • Force Majeure: In the event of facility closure due to unforeseen circumstances, such as natural disasters, government-mandated closures, or public health emergencies, credits or rescheduling options may be offered at the sole discretion of management.

Data Privacy and Security Jordyn’s Splash Academy, LLC is committed to protecting your personal and financial information. All credit card transactions are processed securely through a PCI-compliant payment processor. Please refer to our website for more information. Attorney Review Clause This policy is subject to periodic review and may be updated in response to changes in applicable laws, regulatory requirements, or business practices. Notice of any policy changes will be provided via email and posted on the Parent Portal at least 30 days in advance. Continued use of services following such notice constitutes your acceptance of the revised policy. Governing Law and Venue This policy shall be governed by and construed in accordance with the laws of the State of Texas. All disputes shall be resolved in the state or federal courts located in Collin County, Texas.

Each of the undersigned further agrees that neither Jordyn’s Splash Academy, LLC, nor any of its representatives shall be liable under any circumstances to anyone for exercising the foregoing authority in the event of an emergency. I understand that this authorization is granted in advance to ensure timely medical treatment and that reasonable efforts will be made to contact me or my designated emergency contact prior to treatment. Photo, Video & Media Release

Grant of Rights: I hereby grant to Jordyn’s Splash Academy, LLC (“the School”) and its representatives the right to photograph, record, or otherwise capture the likeness, image, and voice of myself, my child(ren), and any family members who attend or participate in any School program or activity (“Materials”), in any media now known or hereafter developed. Authorized Use: I authorize the School to use, reproduce, publish, display, and distribute the Materials, in whole or in part, for lawful public-facing purposes, including but not limited to: • Publicity • Advertising and marketing • Social media and website • News reporting and promotional materials No Right of Review or Compensation: I understand that neither I nor my family will have any right to inspect or approve the Materials or their use, and waive any right to compensation or royalties. Continued Use After Participation: The School’s rights continue even after I or my child(ren) are no longer participating in School programs. Authority and Warranty: I represent I am at least 18 and the legal parent or guardian of the child(ren) named, with full authority to grant this release. Release and Hold Harmless: I release and hold harmless the School and its representatives from any claims related to the use of the Materials, including privacy, publicity, or defamation. Opt-Out Provision: If you do not consent to the use of you or your child(ren)’s likeness for publicity, advertising, or other public-facing purposes, please write 'Yes' below if you do not consent to media use. You may revoke this consent at any time by contacting support@jsaswim.com. Texas Law & Severability: This release shall be governed by and construed under the laws of the State of Texas. If any provision is held unenforceable, the remainder will continue in full force and effect.

Instructor Safety Policy

Safe Environment

Client agrees to provide and maintain a safe and appropriate environment for all lessons, including those held at neighborhood, or community pools. This includes ensuring clear access to the lesson site, proper maintenance of the pool and surrounding area, and absence of hazardous conditions that may endanger the instructor. 1. Conduct and Supervision Client agrees that all individuals present during the lesson will behave in a respectful and non-disruptive manner. Instructor shall not be subjected to harassment, unsafe behavior, or inappropriate conduct by any person at the lesson location.

  1. Travel Lessons If Client has enrolled in travel-based lessons, they acknowledge that such lessons are conducted off-site at Client-designated locations such as community or neighborhood pools only. To ensure the safety and security of the instructor, lessons will not be conducted at private residences. Client agrees that the selected location must be safe, accessible, and appropriate for instruction. The instructor reserves the right to cancel or reschedule any lesson if the location does not meet these standards or poses a potential risk to their safety or well-being.

  2. Liability Waiver Client agrees to release and hold harmless Jordyn’s Splash Academy, its instructors, agents, and representatives from any and all liability, claims, demands, or causes of action arising out of or related to unsafe conditions or failure to ensure a safe working environment for the instructor.

  3. Right to Refuse Service Jordyn’s Splash Academy reserves the right to refuse, reschedule, or cancel services if, in the sole discretion of the instructor or company, the teaching environment poses a risk to the safety or well-being of the instructor.

0 I certify that if I enroll in a plan where the instructor travels to my preferred pool, I do not intend to schedule lessons at my personal residence. I understand that travel lessons are only held at approved neighborhood or community pools. Accident Prevention & Facility Use

Any swimmer under age 3, or any swimmer who is not fully potty trained, must wear a swim diaper during lessons. While accidents are rare, they are costly to both the swim school and our clients. Cleanup protocols may require temporary pool closure and professional sanitation. In accordance with state recommendations, we take all necessary precautions seriously. Please note: a $100 cleaning fee may apply if a swimmer has an accident in the pool. Restroom access may be limited or unavailable during your scheduled lesson time. We strongly encourage swimmers to use the restroom before arriving. By participating in lessons, clients accept responsibility for managing restroom needs in advance. Facility Security & Internal Video Recording Policy

Purpose of Recording: Jordyn’s Splash Academy, LLC (“the School”) may maintain security video and audio recording systems throughout its facility to protect the safety of students, staff, and visitors, and for internal operational, quality assurance, and training purposes. Scope: Video and audio recordings may capture the likeness, image, and voice of all persons entering or participating in activities within the School’s premises. Use of Recordings: Recordings are for internal use only and may be reviewed by School staff for: • Security and incident response • Staff training and quality assurance • Compliance with School policies Recordings will not be used for publicity, advertising, marketing, or any public-facing purpose without a separate, explicit media release consent. Recordings may be disclosed to law enforcement or government authorities as required by law, regulation, or legal process. Privacy & Confidentiality: The School is committed to maintaining the privacy and confidentiality of all recorded individuals, including minors. Recordings are securely stored and accessible only to authorized School staff, unless disclosure is required by law. Retention: Recordings are retained for a period consistent with School policy and applicable law, and will be securely deleted or destroyed when no longer needed for School operations, investigation, or legal compliance. No Right of Review or Compensation: Recordings are the property of the School. Individuals waive any right to inspect, review, or receive compensation for such recordings when entering the facility. Authority and Acknowledgment: By entering the School facility, you acknowledge and consent to such internal recording as described above. Texas Law & Severability: This policy shall be governed by and construed under the laws of the State of Texas. If any provision is held unenforceable, the remainder will continue in full force and effect.

Text & Email Policy

I understand that text and email notifications are sent for time-sensitive messages, such as weather cancellations, programming updates, and other communications related to the services I have signed up for (e.g., schedule changes or billing reminders). These notifications are separate and distinct from any marketing-related communications, which may be opted out of separately. If I choose to opt out of these notifications, or fail to maintain current contact information, I am solely responsible for any consequences resulting from not receiving timely notifications. I understand that opting out of service-related notifications does not relieve me of any responsibilities for missed information or obligations.
